With the passage of​ Act 2015-3, the Alabama State Department of Education, Public Charter Schools, was established. Its public charter school responsibilities include, but are not limited to, promulgating rules and regulations, developing guidelines for public charter school authorizers and Local Education Agencies, providing support, and responding to requests for information.

The Athens City Board of Education as Charter Authorizer ("ACBE") is charged with approving quality charter proposals that meet identified educational needs and promote a diversity of educational choices, and declining to approve weak or inadequate charter proposals.
Below is the April 1, 2017 Start-Up Charter Application from Teens Path to Success. On May 25th the ACBE took no action on the application with a 3 to 2 vote and 2 board members absent. Without 4 votes the resolution neither passes or fails. After June 1, 2017 (60 day window for approval closes) the applicant may appeal to the Alabama Charter Schools Commission ("ACSC") for approval with the ACSC acting as the authorizer.
